Workplace Investigations

Workplace investigations can be complex, challenging and they can raise serious legal and regulatory issues. Our integrated global team of experts in Bermuda, the BVI, the Cayman Islands, Guernsey and Jersey is trusted by our clients to help with these difficult and sensitive matters. This includes conducting and advising on investigations into all manner of people and cultural issues within an organisation.

Our workplace investigation services

Our team regularly assists organisations with complex workplace investigations across a range of industries, including financial services, insurance, healthcare and education. We have a proven track record conducting workplace investigations, including in relation to misconduct and regulatory compliance, bullying, harassment and discrimination, performance issues, workplace culture, health and safety matters and fitness and propriety issues.

We have particular experience assisting with investigations involving senior executives in regulated financial services environments. Our integrated approach means that our employment and labour law experts work closely with the Carey Olsen regulatory team to identify and help clients deal with regulatory issues as they arise.

We are flexible in our approach to report deliverables and, depending on your needs, can offer everything from a simple fact-finding report to a detailed and confidential board report including recommendations for further action.

Besides conducting external investigations ourselves, we can provide whatever assistance your organisation may require with its internal investigations, including advice and support for your investigators as well as practical assistance, such as document management and forensic analysis.

Recent notable examples of our work include:

  • Being instructed by the board of a listed reinsurance company to investigate allegations of workplace bullying amongst its senior executive team.
  • Conducting a forensic investigation into suspected expenses fraud on behalf of a global accountancy firm.
  • Investigating the historic workplace practices of a healthcare provider to assess legal and regulatory compliance.
