Her practice is focused on cross-border restructuring and insolvency, as well as commercial dispute resolution, in Bermuda, the British Virgin Islands and the Cayman Islands.

She has particular experience in applications for the appointment of “soft touch” or “light touch” provisional liquidators, cross-border restructurings, and has acted for liquidators on an extensive range of matters arising out of liquidations (both compulsory and voluntary), including those requiring the recognition of foreign appointed liquidators.

In addition, she has a broad range of experience in offshore commercial litigation matters. She has acted in high-value and complex commercial disputes involving, inter alia, fraud, breaches of directors’ duties, fund disputes, shareholder disputes, and minority dissent proceedings.

Kimberley is fluent in English, and proficient in Cantonese and Mandarin.

Career

Prior to joining Carey Olsen, Kimberley practiced as a dispute resolution specialist at another offshore law firm. Kimberley’s legal career began in the Corporate Restructuring Workout practice group of one of Singapore’s leading firms, Drew and Napier, and thereafter, she worked for Abraham Vergis SC at Providence Law Asia, a boutique specialist litigation firm in Singapore.

Kimberley was admitted as an advocate and solicitor in Singapore in 2008 (currently non-practising). In 2022, she was admitted as a solicitor in England and Wales (currently non-practising) and a solicitor of the Eastern Caribbean Supreme Court (British Virgin Islands). She is also a Registered Associate of Bermuda.

Acting for the liquidators of China Oceanwide Holdings Limited (715:HK), a distressed Chinese property developer with both onshore and offshore assets and debts.
Acting for DB Trustees (Hong Kong) Limited in winding up proceedings it commenced against Goldin Financial Holdings Limited (530:HK), an investment holding company principally engaged in property development, financial investments, factoring and wine related businesses.
Successfully acted for Kingsbridge Ltd in obtaining sanction for the scheme it proposed to restructure its US$550 million debt. The group owned a fleet of satellites and provided satellite services globally.

Advising an individual stakeholder on a wide range of claims on all aspects of Cayman Islands law arising out of his stake in a web of investment funds which collectively manage billions of US dollars worth of alternative assets with a focus on the PRC. The funds specialised in consumer, technology, healthcare, financial services, logistics and real estate.
Acting for the Hong Kong arm of a large PRC conglomerate in a dispute it had with other stakeholders in a Cayman Islands fund arising out of matters going on at the project-level in the PRC.
Acted as Cayman Islands lead for a Hong Kong company in a high value international arbitration claim.
